ARIZONA GRAND RESORT & SPA “GRAND AMBASSADOR FAMILY” OFFICIAL CONTEST RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: This Campaign is open only to those who enter their information, photo, and story and who are 18 as of the date of entry. The Campaign is only open to legal residents of Arizona and is void where prohibited by law. Employees of Arizona Grand Resort & Spa, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Arizona Grand Resort & Spa as final and binding as it relates to the content of this Campaign.

3. Campaign Period: Entries will be accepted online starting on Friday, July 23, 2021 at 12:01am MST and ending Friday, August 13, 2021 at 11:59pm MST. All online entries must be received by Friday, August 13, 2021 at 11:59pm MST.

4. How to Enter: The Campaign must be entered by submitting an entry using the online form provided at https://www.arizonagrandresort.com/grand-ambassador-family-contest/.  The entry must fulfill all Campaign requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Arizona Grand Resort & Spa. You may enter only once. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Arizona Grand Resort & Spa.

5.         JUDGING/VOTING TO SELECT PRIZE WINNER(S):  A panel of judges will rank each Entry on a scale of 1-10.  Each Entry will be reviewed for the following criteria:

• Composition of the photograph
• Relation to the concept of the contest (Does photo/content show the special traditions made while spending time at the Arizona Grand Resort & Spa)
• Originality
• Essay content
• Social Media Presence

Judges’ decisions are final with respect to all matters relating to the Contest.  Up to five entries with the highest scores will be selected as the semi-finalists of the Contest. Semi-finalists will be contacted no later than August 17, 2021 and will receive complimentary passes for each member of the of the family included in the original entry to spend one day at Oasis Water Park between August 17, 2021 and August 29, 2021. Semi-finalists will be required to post photos and stories on Instagram and Facebook, tagging and geotagging the resort during this visit. A panel of judges will rank each semi-finalist on the following criteria:

• Composition of photographs and stories posted
• Relation to the concept of the contest (Does photo/content show the special traditions made while spending time at the Arizona Grand Resort & Spa)
• Originality
• Accuracy of tagging and geotagging
• Social Media Presence

No information regarding Entries or judging will be disclosed to any third party not involved in the conduct of the Contest.  Sponsor is not responsible for lost, late, misdirected, corrupted, incomplete or damaged Entries. Proof of submission is not proof of receipt by Sponsor.

5. Prizes: The Winner(s) of the Campaign (the “Winner”) will receive 2 complimentary nights every month for 12 months. Nights do not rollover from month-to-month and are subject to availability. Winner will be required to post photos and stories on Instagram and Facebook, tagging and geotagging the resort during each visit. Estimated maximum retail value for all nights awarded is $5000.00. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Arizona Grand Resort & Spa. No cash or other prize substitution shall be permitted except at Arizona Grand Resort & Spa’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation travel expenses, meal expenses, resort charges, any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner and are not included. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Arizona Grand Resort & Spa to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.

6. Winner Selection and Notification: Winner will be selected by Arizona Grand Resort & Spa and announced on Wednesday, September 1, 2021. Winner will be notified by email within five (5) days following selection of Winner. Arizona Grand Resort & Spa shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 3 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT ARIZONA GRAND RESORT & SPA‘S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

7. License and rights  Granted by You: For the good and valuable consideration of participating in the Contest and having your Entry considered for use by Sponsor, or any of their websites and/or as otherwise detailed below, sufficiency of which, you hereby acknowledge, you hereby grant to Sponsor, its parent companies, affiliates, brands, subsidiaries, successors, licensees, agents and agencies and those they may designate from time to time (all of the foregoing, the “Contest Entities”), a non-exclusive, worldwide, perpetual, irrevocable, fully paid-up, royalty-free, fully sublicenseable and transferable right and license to use, copy, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, transmit, display, and perform such Entry, in whole or in part, in any media, format or technology, whether now known or later discovered, and in any manner including all promotional, advertising, marketing, publicity, and commercial uses and ancillary uses thereof, without any further notice or payment to or permission needed from you (except where prohibited by law). You also hereby grant to the Contest Entities an unrestricted, worldwide, perpetual, irrevocable, fully paid-up, royalty-free, fully sublicensable and transferable right to use your name, likeness, Entry, nickname, user name, Instagram user name, and biographical information (collectively “Personal Content”) as contained in your Entry, in composite or distorted form or as otherwise incorporated into other creative works of authorship, in any media, format or technology, whether now known or later discovered, and in any manner including all promotional, advertising, marketing, publicity, and commercial uses and ancillary uses thereof, without any further notice or payment to or permission needed from you (except where prohibited by law). Without limitation of the foregoing, submission of an Entry constitutes your agreement that the Contest Entities are permitted (but are not obligated) to display the Entry online (whether on Contest Entities’ web pages, applications or on third party web pages or applications), to incorporate the Entry in online and offline promotional advertising, marketing, and/or other commercial materials, and to reproduce, adapt and distribute the Entry in all media now known or later developed. In addition, you hereby grant to the Sponsor a worldwide, perpetual, irrevocable, fully paid-up, royalty-free, fully sublicenseable and transferable right and license in and to all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Entry. You represent and warrant that: (i) the Entry and the use of your Entry contemplated in these Official Rules does not and will not infringe on any copyright or trademark or any other third-party right (personal, proprietary, or otherwise) or violate any applicable law or regulation, (ii) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright, trademark and other related rights to the Entry and Personal Content, free and clear of all claims and encumbrances and without violating the rights of any person or entity, including without limitation any right of privacy or publicity or any other personal or proprietary right. You waive any right to inspect or approve uses of the Entry or to be compensated for any such uses.

8. Terms & Conditions: Arizona Grand Resort & Spa reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond Arizona Grand Resort & Spa’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Arizona Grand Resort & Spa may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Arizona Grand Resort & Spa. Arizona Grand Resort & Spa reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. Arizona Grand Resort & Spa has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such an attempt be made, Arizona Grand Resort & Spa reserves the right to seek damages to the fullest extent permitted by law.

9. Limitation of Liability: By entering, You agree to release and hold harmless Arizona Grand Resort & Spa and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

10. Disputes: this campaign is governed by the laws of the United States of America and the state of Arizona, without respect to conflict of law doctrines. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Arizona having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.

12. Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Arizona Grand Resort & Spa, 8000 S. Arizona Grand Parkway Phoenix, Arizona 85044. Requests must be received no later than Wednesday, September 1, 2021.

13. Sponsor: The Sponsor of the Campaign is Arizona Grand Resort & Spa 8000 S. Arizona Grand Parkway Phoenix, Arizona 85044.

14. Facebook: The Campaign hosted by Arizona Grand Resort & Spa is in no way sponsored, endorsed, administered by, or associated with Facebook.

15. By entering the contest, You, the Contestant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
